What is Family Law

Divorce

Child Custody

Child Support

Same-Sex Divorce

Divorce is sometimes the best option in a marriage, same-sex or otherwise. Our firm can apply all our experience in divorce matters to your same-sex divorce.

Same sex divorces typically involve the same issues as divorces between a man and a woman, such as  property division and alimony. That being said, there are often some unique considerations present in LGBTQ+ divorces. This is particularly true when it comes to child custody.

In many LGBTQ+ marriages, both parents might not be on the birth certificates of their minor children. This can make decisions regarding child custody more complicated. While a child born to a same-sex married couple is the legitimate child of both parents under Massachusetts law, issues relating to parental rights can still come up.

Civil Unions

Before the Supreme Court’s decision in Obergefell v. Hodges allowed same-sex marriage across the United States, different states had different recognitions for same sex couple unions. Some had marriage while others only allowed for civil unions. This patchwork of laws means that some couples are still under a civil union and when their union needs to be dissolved, they need a special process that is just short of a divorce.
